Terms of Use

1. The agreement

These Terms govern use of the site and are between you and the registered proprietor of the Kenyan business name Destiny Capsules, trading as BEEKAY GLOBAL. A paid online agreement is formed when you affirmatively accept the checkout policies, submit the transaction and BEEKAY GLOBAL accepts or verifies it. Merely browsing public pages does not create a paid contract.

The offer page, price, access description, these Terms, the Refund and Cancellation Policy, the Digital Product Access Policy and—where BKAI is included—the BKAI Policy together form the applicable online agreement. The Privacy Policy is a notice explaining data handling, not a waiver of privacy rights. A separate signed proposal governs customised speaking, coaching, training or advisory work and prevails for that engagement if it expressly differs.

2. Eligibility and accounts

• You must be at least 18 and able to enter a binding agreement to create a BEEKAY GLOBAL account, purchase or use BKAI. An authorised adult representative may purchase for an organisation.
• Provide accurate information, protect your password and promptly report suspected unauthorised access. One account is for one person unless an institutional licence expressly says otherwise.
• Creating an account is free but does not unlock paid content. Each paid offer requires successful Paystack verification or another expressly stated payment arrangement.
• You are responsible for activity through your account except to the extent caused by BEEKAY GLOBAL’s failure to use reasonable safeguards.

3. Prices and payment

Prices are shown in the currency and form applicable to the selected payment route. You review the exact amount on Paystack before authorising payment. Your bank or mobile-money provider may apply exchange, network or other charges that BEEKAY GLOBAL does not control.

Access is granted only when BEEKAY GLOBAL verifies the provider reference, amount, currency, customer, channel and product details. A pending, reversed, mismatched or fraudulent transaction does not create an entitlement. Taxes will be handled as required by applicable law.

4. Products and access

• eBooks: a personal, non-transferable licence to read the purchased edition, normally delivered through a protected and limited download.
• Courses and lectures: access through the method stated in the offer, which may include Systeme.io or an unlisted YouTube destination after verified payment.
• Insights membership: access to the stated archive and BKAI during the active paid period. A card plan renews monthly until cancelled; a KES/M-PESA pass lasts 30 days and does not renew automatically.
• BKAI credits: prepaid question allowances, valid for the period stated at checkout and not redeemable for cash.
• Free resources: access may still require an account and may be limited by stream, week, availability or other stated conditions.

The Digital Product Access Policy contains the operational delivery terms and forms part of these Terms.

5. Subscription renewal and cancellation

A monthly card membership continues until cancelled through the available Paystack management route or with support. Cancellation stops future renewal and normally leaves access active until the end of the paid period. M-PESA passes and BKAI top-ups never renew automatically. Refund eligibility is governed by the Refund and Cancellation Policy and mandatory law.

6. Intellectual property and permitted use

BEEKAY GLOBAL and its licensors retain ownership of the site, BKAI configuration, articles, course and lecture material, eBooks, designs, trademarks and other protected content. Purchase grants access or a limited personal licence; it does not transfer ownership.

You may make reasonable personal study notes and use ideas with proper attribution. You may not reproduce, resell, upload, distribute, publicly screen, scrape, train another AI system on, remove notices from, or create a competing commercial collection from protected material unless written permission or applicable law allows it.

7. Responsible conduct

Do not misuse the site to break the law, infringe rights, impersonate another person, compromise security, evade payment or access controls, share private links, disrupt service, harvest personal data, send malicious code or use automated means beyond normal indexing and accessibility tools. BKAI use must also follow its dedicated Acceptable Use Policy.

8. Educational and professional limitations

BEEKAY GLOBAL content supports learning, reflection and leadership practice. It does not promise a particular income, promotion, institutional outcome, spiritual result or professional credential unless an offer expressly says so. Public content and BKAI are not substitutes for legal, medical, mental-health, financial, safeguarding, emergency or personalised pastoral advice.

9. Third-party services

Payment, enrolment, video, email and booking may depend on Paystack, Systeme.io, YouTube, Resend, Calendly, OpenAI and infrastructure providers. Their separate terms apply to their platforms. BEEKAY GLOBAL remains responsible for its own promises and will use reasonable efforts to restore or provide an equivalent access route when a provider failure prevents delivery.

10. Availability, changes and suspension

We may maintain, improve, replace or withdraw features, but will not knowingly reduce an already-paid core entitlement without a reasonable remedy. Access may be limited or suspended to protect users, investigate fraud, respond to non-payment, enforce these Terms or comply with law. Where appropriate, we will explain the reason and provide a route for review.

11. Warranties and liability

We will provide paid services with reasonable care and skill and supply content that materially matches the published description. We do not guarantee uninterrupted internet access, error-free third-party platforms or that every educational or AI output will fit your circumstances.

To the fullest extent permitted by law, BEEKAY GLOBAL is not liable for indirect, consequential or speculative loss arising from use of the site. Any limit will not exclude fraud, wilful misconduct, compensation or another remedy available under the Kenya Data Protection Act, a mandatory remedy under consumer-protection law, or any other liability that cannot lawfully be excluded. For a one-time paid offer, any otherwise lawful monetary cap is the price paid for that offer; for a recurring service, it is the fees paid for that service during the twelve months before the event giving rise to the claim.

12. Complaints, law and disputes

Send a complaint with the account email, transaction reference and desired resolution. The parties should first make a genuine effort to resolve it directly. These Terms are governed by the laws of Kenya, and unresolved disputes may be brought before a court or other competent forum in Kenya, without taking away any mandatory forum or consumer right that applies to you.

The Kenya Consumer Protection Act and other applicable law prevail over any inconsistent limitation. If one provision is unenforceable, the remainder continues.

13. Updates

The version accepted at checkout applies to that transaction. We may update terms prospectively for security, service or legal reasons. Material changes affecting an ongoing paid service will be notified or presented for acceptance where required.
